How foreclosure works in Tennessee
Tennessee foreclosures are usually non-judicial. Most home loans use a deed of trust, so a trustee can sell the house at auction without a lawsuit. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.
Once it starts, it moves fast. Since July 1, 2025, the sale must be advertised at least twice in a local newspaper, with the first ad at least 20 days before the sale, and posted online for at least 20 days. The trustee also has to mail the notice to the borrower by the first publication date.
What that means for you: in Tennessee, the time between the first ad and the auction can be only about three weeks. If you're behind, call us before the ads start, not after.
Inherited houses and probate in Tennessee
Which court handles probate depends on the county. Shelby County has a dedicated Probate Court, Davidson County uses the Seventh Circuit Court, and Knox County uses its Chancery Court.
- Small estates: Tennessee's small-estate process covers personal property worth $50,000 or less. It cannot transfer a house or land, so inherited real estate usually needs a regular estate or the signatures of all the heirs.
- No transfer-on-death deeds: Tennessee does not currently recognize transfer-on-death deeds for real estate, so inherited houses more often go through probate or need every heir to sign.
We work with executors, administrators and heirs, including families spread across several states. See our pages on inherited houses and probate.
Transfer tax
Tennessee charges a transfer tax of 37 cents per $100 of the sale price when a deed is recorded. By law, the buyer (the person receiving the property) pays it, so when you sell to us, that tax is ours.
Tennessee landlords
In Shelby, Davidson and Knox counties, and the other counties covered by Tennessee's Uniform Residential Landlord and Tenant Act, a landlord must give a written 14-day notice to pay or cure before filing for unpaid rent. Eviction cases are then heard in the county's General Sessions Court. If you're done managing tenants, we can buy with tenants in place.
