How foreclosure works in Kansas

Kansas is a judicial foreclosure state. The lender files a lawsuit in the county District Court, gets a judgment, and the house is sold at a sheriff's sale that the court must confirm. Federal servicing rules generally stop a lender from filing until a borrower is more than 120 days behind.

Kansas also gives homeowners a right of redemption after the sale. The standard period is 12 months, but it is cut to 3 months if less than one-third of the original loan had been paid when the default happened, and a court can shorten it for an abandoned house. During that time the owner can buy the house back for the sale price plus interest and costs.

What that means for you: a Kansas foreclosure takes a while, which gives you time to sell and keep your equity. Selling before the sheriff's sale is almost always better than trying to redeem after it.

Inherited houses and probate in Kansas

Probate in Kansas is handled by the District Court of the county where the person lived.

  • Small estates affidavit: if the probate estate is $75,000 or less, heirs can collect personal property with an affidavit (K.S.A. 59-1507b). It does not transfer a house, so real estate usually needs a probate case or another court procedure.
  • Transfer-on-death deeds: Kansas allows TOD deeds. If the owner recorded one before death, the named beneficiary may be able to take the house without probate.

We can sign a contract while the estate is open and close when the court and title company are ready. See inherited houses and probate.

Transfer tax

Kansas has no real estate transfer tax. Deeds are usually recorded with a Sales Validation Questionnaire, plus normal recording fees.

Kansas landlords

If rent is late, a Kansas landlord can give a written three-day notice to pay (two extra days if it's mailed) before ending the lease and filing an eviction. Tired of being a landlord? We buy rentals with tenants in place.
