How foreclosure works in Virginia

Most Virginia home loans use a deed of trust, so foreclosure is usually a non-judicial trustee's sale. For an owner-occupied home, the trustee generally has to give the owner 60 days' notice before the sale. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.

What that means for you: once the sale notice arrives, you have about two months. Call early.

Inherited houses and probate in Virginia

In Virginia, wills are probated and administrators qualified in the Circuit Court Clerk's Office in the city or county where the person lived. Virginia's cities are independent of its counties, so a Richmond or Alexandria estate goes through that city's own circuit court.

  • Small estates: heirs can collect personal property by affidavit when it's worth $75,000 or less, 60 days after death.

Grantor tax

Virginia's grantor tax is 50 cents per $500 of the price, paid by the seller. In Northern Virginia, including Alexandria, there's also a regional congestion relief fee of 10 cents per $100. Buyers pay the recordation tax.

Virginia landlords

For unpaid rent, Virginia currently requires a written 14-day pay-or-quit notice before a landlord can end the lease and file for possession. We buy rentals with tenants in place.
