How foreclosure works in Texas
Texas foreclosures are usually non-judicial and fast. For a homestead, the lender must give at least 20 days to cure the default, then at least 21 days' notice of sale. Sales happen on the first Tuesday of the month, between 10 a.m. and 4 p.m. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.
What that means for you: in Texas, the time between the first notice and the auction can be about six weeks. If you're behind, call us now.
Inherited houses and probate in Texas
Texas counties handle probate in their county courts, and big counties like Tarrant and El Paso have dedicated statutory probate courts.
- Small estate affidavit: available only when there's no will, the estate is $75,000 or less (not counting exempt property), and the only real estate is a homestead going to a spouse or minor children.
- Heirship: many Texas families sell inherited houses after the heirs are established through an heirship proceeding or a recorded affidavit of heirship, and title companies will tell you what they need.

No transfer tax
Texas has no real estate transfer tax and no state income tax. Property taxes are high, though, so an empty inherited house gets expensive to hold.
Texas landlords
For eviction cases filed on or after January 1, 2026, a landlord generally gives three days' written notice to vacate before filing, unless the lease sets a different period. We buy rentals with tenants in place.
