How foreclosure works in North Carolina
Most North Carolina home loans use a deed of trust with a power of sale, but there's still a hearing in front of the county Clerk of Superior Court before the sale can happen. Borrowers generally get notice at least 10 days before that hearing. After the auction, there's a 10-day upset bid period. Anyone can top the high bid by at least 5% (and at least $750), and each new bid restarts the 10 days.
What that means for you: you have a few chances to act, but the process moves once the hearing is set. Selling before the sale protects your equity best.
Inherited houses and estates in North Carolina
Estates are opened with the Clerk of Superior Court (Estates Division) in the county where the person lived.
- Small estates: if personal property is $20,000 or less, or $30,000 when the surviving spouse inherits everything, heirs can collect it by affidavit after 30 days. That doesn't cover the house.
- Heirs and real estate: title to real estate passes to the heirs at death. If heirs sell within two years of the death, the estate's personal representative is usually asked to sign too, to protect the title from creditors.

Excise tax
North Carolina's excise tax on deeds is $1 per $500 of the price, paid by the seller when the deed is recorded.
North Carolina landlords
For unpaid rent, a landlord makes a demand for the rent and waits 10 days before filing for summary ejectment in small claims court. We buy rentals with tenants in place.
