How foreclosure works in New Mexico

New Mexico is a judicial foreclosure state. The lender files in District Court, and after judgment the house is sold. The owner generally has nine months after the sale to redeem, though the mortgage can shorten that to as little as one month. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.

What that means for you: there's usually time to sell before the sale. Selling protects equity that a foreclosure can take.

Inherited houses and probate in New Mexico

Simple, uncontested estates can often be opened informally in the county Probate Court, and more complicated ones go to District Court.

  • Transfer on death deeds: New Mexico allows TOD deeds. If the owner recorded one before death, the house passes without probate.

No transfer tax

New Mexico has no real estate transfer tax, just normal recording fees.

New Mexico landlords

For unpaid rent, a landlord gives a written three-day notice before filing. If you're done, we buy with tenants in place.
