How foreclosure works in Minnesota

Most Minnesota foreclosures are foreclosure by advertisement, without a lawsuit, and end in a sheriff's sale. After the sale, homeowners usually have a six-month redemption period to buy the house back and can generally stay in the home until it ends. Some properties get 12 months, and a court can cut it to five weeks for an abandoned home. Federal servicing rules generally stop the process until a borrower is more than 120 days behind.

What that means for you: you can sell before the sheriff's sale, and often during the redemption period too. Earlier is better for protecting equity.

Inherited houses and probate in Minnesota

Probate is handled by the District Court in the county where the person lived.

  • Small estates: heirs can collect personal property with an affidavit when the probate estate is $75,000 or less, but only if there's no solely owned real estate. A house generally means probate.
  • Transfer on death deeds: Minnesota allows TOD deeds. If one was recorded, the house may pass without probate.

Deed tax and pre-sale inspections

Minnesota's deed tax is 0.33% of the price, plus 0.01% in Hennepin and Ramsey counties, and sellers customarily pay it. Minneapolis and St. Paul also require a Truth in Sale of Housing (TISH) evaluation before most homes can be listed or shown. If you'd rather skip that, we can buy as-is.

Minnesota landlords

For unpaid rent, Minnesota now requires a detailed written notice at least 14 days before filing an eviction. We buy rentals with tenants in place.
