How foreclosure works in Michigan

Most Michigan foreclosures are foreclosure by advertisement, so they don't need a lawsuit. The sale is advertised in a local newspaper and the house is sold at a sheriff's sale. After the sale, most homeowners have a six-month redemption period to buy it back. Some properties get a year, and abandoned homes can get less. Federal servicing rules generally stop the process until a borrower is more than 120 days behind.

What that means for you: you can sell before the sheriff's sale, and in many cases during the redemption period too. Selling earlier usually protects more of your equity.

Inherited houses and probate in Michigan

Each Michigan county has a Probate Court.

  • Small estates: for a 2026 death, heirs can collect personal property by affidavit when the estate is $53,000 or less, but only if there is no real estate. When there's a house, a small estate goes through a court Petition and Order for Assignment, and larger estates go through probate.
  • Deeds that skip probate: many Michigan owners use an enhanced life estate ("Lady Bird") deed, which passes the house directly at death.

Transfer tax and property tax "uncapping"

Michigan's transfer tax is 0.75% state plus 0.11% county, 0.86% total, and sellers customarily pay it. After most sales, the house's taxable value "uncaps," so the new owner's property taxes can jump. Buyers factor that into what they'll pay.

Michigan landlords

For unpaid rent, a Michigan landlord serves a seven-day demand for possession before filing in district court. Grand Rapids also requires rental registration and inspections. We buy rentals with tenants in place.
