How foreclosure works in Massachusetts
Massachusetts foreclosures are mostly non-judicial, but lenders first have to bring a short Servicemembers case in Land Court or Superior Court to confirm the owner isn't on active military duty. Before accelerating the loan, the lender must send a right-to-cure notice, currently giving 90 days to catch up. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.
What that means for you: there are several steps before a sale, which gives you time to sell and keep your equity.
Inherited houses and probate in Massachusetts
Estates go through the Probate and Family Court for the county where the person lived.
- Voluntary administration: if the estate is only personal property worth $25,000 or less (plus one car), a family member can use a simpler process after 30 days. It doesn't cover a house.

Deed excise and the lead law
Massachusetts charges a deed excise of $4.56 per $1,000 of the price, customarily paid by the seller. Massachusetts also has one of the strictest lead laws in the country. When a child under six lives in a pre-1978 home, the owner must have lead hazards removed or contained. For landlords with older units, that can be a big cost.
Massachusetts landlords
For unpaid rent, a landlord generally serves a 14-day notice to quit before filing a summary process case. If you're done, we buy with tenants in place, including units that haven't been deleaded.
