How foreclosure works in Maryland

Maryland foreclosures are filed in the county Circuit Court, even when the loan has a power of sale. The lender has to send a Notice of Intent to Foreclose at least 45 days before filing. Owner-occupants can ask for foreclosure mediation, and after the case is filed, a borrower generally has 25 days to request it. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.

What that means for you: Maryland gives you some time and a mediation option. Selling before the sale can protect your equity.

Inherited houses and probate in Maryland

Estates are opened with the Register of Wills in each county (and in Baltimore City). Disputes go to the Orphans' Court.

  • Small estates: if probate assets, net of secured debts, are $50,000 or less, or $100,000 or less when the surviving spouse is the only heir, the estate can use simpler small-estate procedures.

Transfer and recordation taxes

Maryland charges a 0.5% state transfer tax, and most counties add local transfer and recordation taxes. In Baltimore City, the city transfer tax is 1.5% and the recordation tax is generally $5 per $500. Your offer from us will spell out who pays what.

Maryland landlords

Maryland requires rental units built before 1978 to be registered with the state, with a lead inspection certificate at each tenant turnover, unless the unit is certified lead-free. Baltimore City also requires rental registration and licensing. If you're done with tenants, we buy with tenants in place.
