How foreclosure works in Indiana
Indiana is a judicial foreclosure state. The lender files in the county court, and homeowners can ask for a settlement conference with the lender within 30 days after being served. For most home loans, the sheriff's sale can't happen until at least three months after the case is filed. Federal servicing rules generally stop a lender from filing until a borrower is more than 120 days behind.
What that means for you: there is usually time to sell before a sheriff's sale. Selling can protect equity that a foreclosure would take.
Inherited houses and probate in Indiana
Indiana estates are opened in the county's probate court, or the circuit or superior court that hears probate.
- Small estates: for deaths after June 30, 2022, heirs can collect personal property with an affidavit when the estate is $100,000 or less. That affidavit doesn't transfer a house. Real estate needs either a separate recorded affidavit, where the law allows it, or a probate case.
- Transfer-on-death deeds: Indiana allows TOD deeds. If one was recorded before death, the beneficiary records an affidavit and may not need probate for the house.

Transfer tax
Indiana has no real estate transfer tax. Sales are reported on a sales disclosure form, plus normal recording fees.
Indiana landlords
For unpaid rent, Indiana generally requires at least a 10-day notice before ending the lease, and the tenant can stop it by paying in full within that time. Tired of it? We buy with tenants in place.
