How foreclosure works in Georgia

Georgia has one of the fastest foreclosure processes in the country. Most home loans use a security deed with a power of sale, so there's no lawsuit. The lender must give 30 days' written notice and advertise the sale once a week for four weeks in the county's legal newspaper. Sales happen on the first Tuesday of the month at the courthouse. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.

What that means for you: once the ads start, you may have about a month. If you're behind in Georgia, call us right away.

Inherited houses and probate in Georgia

Each Georgia county has a Probate Court.

  • No administration necessary: if there's no will, no debts (or creditors agree) and all heirs agree on how to divide things, heirs can ask the probate court for an order that no administration is necessary, which can include the house.
  • Otherwise, the court appoints an executor or administrator who can sell the house.

Transfer tax

Georgia's real estate transfer tax is $1 per $1,000 of the price, customarily paid by the seller.

Georgia landlords

In Georgia, a landlord must make a written demand for possession before filing a dispossessory case in magistrate court, and a 2024 state law added a short pay-or-vacate notice requirement for unpaid rent. If you're done, we buy with tenants in place.
