How foreclosure works in Delaware
Delaware is a judicial foreclosure state. The lender files a "scire facias sur mortgage" action in Superior Court, and the house is sold at a sheriff's sale after judgment. Delaware also runs a residential mortgage foreclosure mediation program for homeowners. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.
What that means for you: there's usually time to sell before the sheriff's sale. Selling can protect equity that a foreclosure would take.
Inherited houses and probate in Delaware
Estates are opened with the Register of Wills in the county where the person lived. Disputes are heard in the Court of Chancery.
- Small estates: Delaware allows a small-estate affidavit for modest estates of personal property. A house usually needs a regular estate.

Realty transfer tax
Delaware's realty transfer tax is high compared with most states. In Wilmington, the total is about 4%: 2.5% to the state, usually split between buyer and seller, plus 1.5% to the city, usually paid by the seller. Your offer from us will spell out who pays what.
Delaware landlords
For unpaid rent, a Delaware landlord gives a written demand with at least seven days to pay before filing for possession. We buy rentals with tenants in place.
