How foreclosure works in Colorado
Colorado has its own system, where each county's Public Trustee runs the foreclosure. The process starts when the Public Trustee records a Notice of Election and Demand. In Denver, the auction is then scheduled about 110 to 125 days later. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.
What that means for you: you have about four months from the start, so call early.
Inherited houses and probate in Colorado
Denver has its own Denver Probate Court, which hears all probate cases in Denver. Elsewhere in Colorado, probate goes through the county District Court.
- Small estates: for a 2026 death, heirs can collect up to $88,000 in personal property by affidavit, but it can't transfer real estate.
- Beneficiary deeds: Colorado allows beneficiary deeds that pass a house at death without probate.

Transfer fee
Colorado's state documentary fee is just one cent per $100. Some cities and towns have their own transfer taxes.
Colorado landlords
For unpaid rent, a landlord gives a 10-day demand to pay before filing an eviction. Denver also requires rental licenses. We buy with tenants in place.
