How foreclosure works in California
Most California foreclosures are non-judicial trustee sales. The trustee records a notice of default, and the sale can't happen until at least three months and 20 days later, with the notice of sale at least 20 days before the sale. Federal servicing rules generally stop the process from starting until a borrower is more than 120 days behind.
What that means for you: you have about four months from the notice of default. Selling before the sale protects your equity.
Inherited houses and probate in California
Probate is handled by the county Superior Court.
- Small estates: for deaths on or after April 1, 2025, personal property up to $208,850 can pass by affidavit.
- Primary residence petition: heirs can ask the court for an order passing a decedent's primary residence worth up to $750,000, without full probate.
- Prop 19 and property taxes: an inherited house is generally reassessed to market value unless a child moves in as their primary residence within a year (and meets a value cap). For heirs who don't plan to live there, the higher tax bill is a common reason to sell.

Transfer tax
Counties charge a documentary transfer tax, and some cities, including Sacramento, add their own. Your offer from us will spell out who pays what.
California landlords
For unpaid rent, a landlord serves a three-day notice to pay or quit (weekends and court holidays don't count). Many rentals are also covered by the statewide rent cap and just-cause rules. We buy with tenants in place.
